Tax residency questions reach Qatar companies from two directions. A foreign customer or bank asks a Qatar company for proof that it is resident in Qatar, so that a treaty can reduce tax abroad. And a foreign supplier or seller asks the Qatar company paying it whether a treaty reduces the tax withheld in Qatar.

The two questions need different documents. The first needs a tax residency certificate (TRC) issued by the General Tax Authority (GTA). The second needs a certificate from the foreign party’s own country, and in most cases the relief comes later, as a refund.

This guide explains the residence tests in the Income Tax Law, how to request a Qatari certificate on Dhareeba, when the GTA can refuse one, where to find Qatar’s treaties and the three routes to treaty relief in Qatar, with the official source for each rule.

The short answer

In short

  • An individual is resident in Qatar if they have a permanent home there, stay more than 183 days in the year or are Qatari. A company must be established in Qatar and managed and controlled from Qatar (Income Tax Law Article 1).
  • A Qatari tax residency certificate is requested on Dhareeba. The GTA may refuse one to an entity that does not meet the minimum substance indicators (Law Article 11 bis).
  • A foreign supplier claiming treaty relief in Qatar needs a certificate from its own country, not a Qatari one (Executive Regulations Article 47).
  • For most payers, relief comes by refund after the 5% is withheld. Only approved “Trusted Entities” apply treaty rates at source, and capital gains relief is by paying first and claiming a refund.

Who is a tax resident of Qatar?

Article 1 of the Income Tax Law defines a resident. The tests are different for individuals and for companies.

An individual is resident if they have a permanent home available in Qatar, or stayed in Qatar for more than 183 days in the year, whether continuously or not, or hold Qatari nationality. Meeting one of these tests is enough. For companies and other entities the test is stricter, because an entity is resident only if its place of establishment is in Qatar and its main and actual place of management and control is in Qatar. Both conditions must be met.

The law explains the actual place of management as the place where executives and senior management take the strategic, commercial, financial and operational decisions, or do their daily work (Article 1). A company registered in Qatar but run from abroad may therefore not be resident under the law.

A residence permit is not one of the legal tests; what counts is the home, the days or the nationality. For an overview of the taxes on companies, see taxes in Qatar for companies, and for branches of foreign companies, see our page on foreign company branches.

What a tax residency certificate is used for

A TRC is the GTA’s confirmation that an individual or company is resident in Qatar. Dhareeba describes it as issued to individuals and companies residing in Qatar, with the Income Tax Law Article 1 as the legal reference.

Its usual use is abroad. A foreign tax authority, payer or bank asks for it before it applies a treaty between its country and Qatar, for example to reduce the tax it withholds on fees, interest or dividends paid to the Qatar resident. Each foreign country decides what it accepts. Before applying, ask the foreign party which period the certificate must cover, which language it needs and whether it has its own form.

How to request a TRC on Dhareeba

The Dhareeba service “Request a Tax Residency Certificate” names taxpayers registered with the GTA as its target group. If you are not registered yet, start with Dhareeba registration and the tax card. The steps on the service page are:

  1. 1

Sign in to Dhareeba and open Requests, then Tax Residency Certificate.

  2. 2

    Create the request

Choose Create and read the instructions shown.

  3. 3

    Complete the fields

Fill in the details asked for and attach the supporting documents.

  4. 4

    Add notes

Add any notes that explain your situation.

  5. 5

    Check the summary

Review the summary of the request.

  6. 6

    Declare and submit

Accept the declaration and submit the request.

  7. 7

    Follow up

Follow the notifications on Dhareeba, including any request for more information.

The documents Dhareeba lists depend on who is applying:

  • Individuals: a travel movement record showing more than 183 days in Qatar within 12 months; proof of a permanent home, such as a lease contract or an electricity bill; and a copy of the employment contract.
  • Companies: the commercial register and commercial licence, with the head office and the place of effective management in Qatar.

The GTA’s user guide (2020) shows that the form asks for the place of effective management, the certificate language (English or Arabic), who the certificate will be shared with and the period it covers. Individuals answer questions on the 183 days, a permanent home and their centre of vital interests, with evidence such as a lease, a Kahramaa bill, school registration or an employer’s letter. Screens may have changed since 2020.

The Dhareeba service page does not state a fee, a processing time or a validity period. Check them on Dhareeba when you apply, and do not rely on figures quoted elsewhere.

When the GTA can refuse a certificate: the substance rule

The GTA may refuse to issue a tax residence certificate to an entity that does not meet the minimum indicators of core activity (Income Tax Law Article 11 bis). The details are in Executive Regulations Article 34 bis.

The rule mainly catches entities with more than 75% of their revenue from real estate income, dividends, interest or royalties in the previous two years, which also meet the asset or foreign-income test or outsource their management. The exceptions include listed companies, licensed financial institutions, certain holding companies with resident owners, and entities with at least five full-time employees. An entity that is caught must evidence the indicators: a dedicated office in Qatar, a Qatari bank account, and either a resident director who takes decisions or a majority of resident staff.

Holding companies and property-owning companies that plan to ask for a certificate should keep this evidence ready, as the same indicators are reported in the tax return.

Which countries have a tax treaty with Qatar?

The official list is the Tax Agreements page of the GTA website. It lists Qatar’s bilateral agreements with links to the texts in English and Arabic, and two multilateral instruments: the multilateral convention on base erosion and profit shifting, and the convention on mutual administrative assistance in tax matters. The GTA can also exchange information with foreign tax authorities under these agreements (Law Article 13 bis).

Qatar signed a double tax agreement with the United Arab Emirates on 30 May 2024 and one with Kuwait on 1 June 2025, as reported by the GTA. A signed treaty is not the same as one in force. Check that the treaty is in force for the year concerned before relying on it.

Always read the specific treaty. Each one sets its own rates, its own permanent establishment rules, its own article on capital gains and its own anti-abuse rules. Qatar’s domestic rules, for example a building site lasting more than six months or services through staff for more than 183 days in any 12 months (Regulations Article 1(2)), may differ from the treaty. Our tax advisory service includes a check of the treaty that applies to a transaction.

How treaty relief works in Qatar

Withholding tax in Qatar is “subject to the provisions of tax agreements” (Law Article 9(2)). In practice there are three routes, depending on who pays and what is paid.

Routes to treaty relief for non-residents in Qatar
RouteWho uses itWhat the non-resident providesSource
Refund after withholdingMost payers: the 5% is withheld and remitted, then the non-resident claims a refundA TRC from its country of residence for the year of withholding, the contract, withholding certificates and the treaty provisions relied onRegs Arts. 22 and 47; Law Art. 23

Capital gains: pay and refundNon-resident sellers of Qatar shares or propertyThe capital gains declaration and full payment first, then a refund claim with a TRC for the periodGTA capital gains guide, section 10
Checked on 16 October 2026.

For refunds, the GTA decides within 60 days; no reply counts as a rejection, which can be taken to the Tax Grievance Committee (Law Article 23; Regulations Article 47). The right to claim a refund ends five years after it is established that the tax was not due and the taxpayer becomes aware of it (Law Article 39). Withholding still applies to non-resident companies owned by Qatari or GCC nationals (Regulations Article 22(3)).

“Trusted Entity” status, introduced in 2026, is open to ministries, government bodies, financial institutions, listed companies and others the GTA President approves, with at least 1,250 withholding transactions or at least QAR 10,000,000 withheld in the previous year. The status lasts three years. It is not a route for most SMEs.

For the full refund documents and the withholding rules, see withholding tax in Qatar. For capital gains, see capital gains tax in Qatar.

Common mistakes

The most common mistake is using the wrong country’s certificate. A foreign supplier claiming relief in Qatar needs a TRC from its own country, and a Qatari TRC does not help it. The certificate must also cover the right period, meaning the year of the payment or the period of the sale. Another error is assuming that a signed treaty is in force, so check the status before applying it.

Payers sometimes withhold at the treaty rate without approval. A payer that is not a “Trusted Entity” and withholds less than required faces a penalty equal to the tax not withheld, plus the tax (Law Article 24(7)). Finally, a holding or property company without an office, bank account or resident decision-maker in Qatar may be refused a certificate for lack of substance evidence.

What to do next

If you need a Qatari certificate, check the residence tests and gather the documents before you open the request. If you pay foreign suppliers, decide how you will handle treaty claims. Our tax advisory service checks the treaty and helps you prepare the request and documents, our withholding tax service covers payments to non-residents, and our tax card registration page covers registering first. Frequently asked questions

How do I get a tax residency certificate in Qatar?

Request it on Dhareeba under Requests, then Tax Residency Certificate, and attach the documents the service lists. The GTA reviews the request and may ask for more information. The service names taxpayers registered with the GTA as its target group.

How many days must I spend in Qatar to be tax resident?

More than 183 days in the year is one test; a permanent home in Qatar or Qatari nationality also makes you resident (Income Tax Law Article 1). Dhareeba asks individuals for a travel record showing more than 183 days in 12 months.

Can a company with a foreign head office get a Qatari TRC?

Dhareeba requires the head office and the place of effective management to be in Qatar. The law needs both establishment in Qatar and main and actual management and control in Qatar (Income Tax Law Article 1).

Can the GTA refuse a tax residency certificate?

Yes. It may refuse one to an entity that does not meet the minimum indicators of core activity, such as an office, a Qatari bank account and resident decision-makers (Law Article 11 bis; Executive Regulations Article 34 bis).

Our foreign supplier is in a treaty country. Do we withhold less?

Usually not. Most payers withhold the 5% and the supplier claims a refund with a TRC from its own country (Executive Regulations Articles 22 and 47). Only payers approved as a “Trusted Entity” apply treaty rates at source.

Where can I find Qatar’s tax treaties?

On the Tax Agreements page of the GTA website, with the texts in English and Arabic. Check that the treaty is in force for the year concerned, and read its articles on rates, permanent establishment and capital gains.

Does a treaty remove capital gains tax for a foreign seller?

Only if the treaty gives the taxing right to the seller’s country. According to the GTA’s capital gains guide, the seller still files and pays in Qatar, then claims a refund with a TRC for the period.
